These Terms of Service govern your use of nocteyewear.com and purchases from NOCT Eyewear, a brand and online store operated by MTG GLOBAL, LLC. By using the site or placing an order, you agree to these Terms and to the policies linked on the site. If you do not agree, do not use the services.
Eligibility and accounts
You must be legally able to enter into a binding contract in your jurisdiction. You are responsible for providing accurate information, protecting account credentials, and activity under your account. Notify us promptly if you believe an account has been used without authorization.
Products and product information
We work to present product names, images, colors, options, descriptions, and prices accurately. Screen settings, lighting, photography, and production variation can affect appearance. Review all available images and information before purchase.
Unless a product page expressly states and substantiates a specific technical or protective rating, products are sold as non-prescription fashion eyewear and not as safety eyewear, medical devices, or a substitute for professional eye care.
Availability can change without notice. We may limit quantities, correct errors, update information, or discontinue products.
Orders and acceptance
Submitting an order is an offer to purchase. An automated confirmation acknowledges receipt but does not require us to accept the order. We may accept, reject, limit, or cancel an order for reasons including unavailable inventory, suspected fraud, pricing or description errors, payment problems, duplicate orders, or shipping restrictions. If we cancel after payment, we will refund the amount charged for the canceled item or order.
You are responsible for reviewing the product, quantity, delivery address, and contact information before submitting the order. Changes and cancellations are governed by our Cancellation and Order Changes Policy.
Prices, currency, taxes, and payment
Prices are displayed in United States dollars unless the site or checkout expressly shows another currency. Prices can change without notice, but changes do not affect an accepted order. Discounts and promotions are subject to their stated conditions and availability.
Applicable taxes and charges collected by us are shown at checkout where required. Payment methods are displayed at checkout and processed by Shopify and payment providers. You authorize the applicable provider to charge the payment method submitted and confirm that the information is accurate and that you are authorized to use it. See our Payment Policy.
Shipping and fulfillment
We currently ship to eligible addresses in our United States shipping zone using the free Standard option described in our Shipping Policy. Delivery dates are estimates, not guarantees.
We work with third-party suppliers, fulfillment partners, and carriers. Shipment origin and carrier can vary by product, inventory, and destination, and items in one order may ship separately. You are responsible for providing a complete and accurate address.
Returns, refunds, and cancellations
Returns, return shipping, damaged or incorrect items, non-returnable items, and refunds are governed by our Refund and Return Policy. Cancellation requests must be submitted within 15 minutes of purchase and before processing begins, as explained in our Cancellation and Order Changes Policy.
Promotions and discount codes
Promotions may have eligibility, timing, product, quantity, or combination restrictions. Unless expressly stated, promotions cannot be exchanged for cash, applied retroactively, or combined. We may correct or cancel a promotion affected by an error, fraud, or abuse, subject to applicable law.
Intellectual property
The site and its content, including names, logos, graphics, photographs, text, layouts, and software, are owned by or licensed to NOCT Eyewear or MTG GLOBAL, LLC and are protected by applicable laws. You may use the site only for personal, non-commercial shopping. You may not copy, reproduce, distribute, modify, scrape, sell, or exploit site content without written permission.
Acceptable use
You may not use the services for unlawful, fraudulent, abusive, or harmful activity; interfere with security or operation; introduce malicious code; impersonate another person; collect information about others without authorization; attempt unauthorized access; or violate the rights of NOCT, Shopify, or any third party.
Third-party services and links
Some features rely on Shopify and other third-party services. We do not control third-party sites or services and are not responsible for their independent terms, content, availability, or privacy practices. Review their terms before using them.
Feedback and submissions
If you voluntarily submit feedback or ideas, you grant MTG GLOBAL, LLC a non-exclusive, worldwide, royalty-free right to use them to operate and improve the business without an obligation to compensate you. Do not submit material that infringes another person's rights or contains unlawful or harmful content.
Service availability and corrections
We may correct errors, update information, suspend features, or modify the services. We do not guarantee that the site will always be uninterrupted, secure, or error-free.
Disclaimers
To the maximum extent permitted by law, the site and services are provided on an "as available" basis. We disclaim warranties that can legally be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
Limitation of liability
To the maximum extent permitted by law, MTG GLOBAL, LLC, NOCT Eyewear, and their service providers will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the services. Where liability cannot be excluded, it is limited to the amount paid for the product or service giving rise to the claim unless applicable law requires otherwise.
Indemnification
To the extent permitted by law, you agree to indemnify MTG GLOBAL, LLC for third-party claims arising from your unlawful use of the services or material breach of these Terms. This does not apply to claims caused by our own unlawful conduct.
Termination
We may suspend or terminate access when reasonably necessary to protect the store, customers, or third parties, or when these Terms are materially violated. Provisions that by their nature should survive termination will continue to apply.
Governing law
These Terms and disputes arising from them are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Nothing in these Terms limits mandatory consumer-protection rights available under the law of your state of residence.
Severability and waiver
If part of these Terms is found unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver.
Changes
We may update these Terms by posting a revised version with a new effective date. The version in effect when an order is placed applies to that order to the extent permitted by law.
