These Terms of Service govern your use of nocteyewear.com and purchases from NOCT Eyewear. By using the site or placing an order, you agree to these Terms and the policies linked on the site. If you do not agree, do not use the services.

Eligibility and accounts

You must be legally able to enter into a binding contract in your jurisdiction. You are responsible for providing accurate information, protecting account credentials, and all activity under your account. Notify us if you believe your account has been used without authorization.

Products and availability

We work to display products, colors, images, descriptions, and prices accurately. Screens and lighting can affect how colors appear. Product availability can change without notice, and we may limit quantities or discontinue products.

Orders

An order is an offer to purchase. We may accept, reject, limit, or cancel an order for reasons including unavailable inventory, suspected fraud, pricing or description errors, payment problems, or shipping restrictions. If we cancel an order after payment, we will refund the amount charged for the canceled item or order.

You are responsible for reviewing the product, delivery address, and contact details before submitting an order. Contact us promptly if something is incorrect, but we cannot guarantee that an order can be changed after processing begins.

Prices, billing, and payment

Prices are shown in the store currency and can change without notice. Applicable taxes are presented at checkout where required. Free Standard shipping is available for eligible United States orders. You authorize us and our payment providers to charge the payment method submitted for your order. You confirm that the billing and payment information you provide is accurate and that you are authorized to use the payment method.

Shipping and delivery

We currently ship only within the United States using the free Standard option described in our Shipping Policy. Delivery dates are estimates, not guarantees. Risk of loss and title transfer as provided by applicable law and carrier terms. You are responsible for entering a complete and accurate address.

Returns and refunds

Returns, exchanges, and refunds are governed by our Refund Policy. The policy forms part of these Terms.

Intellectual property

The site and its content, including names, logos, graphics, photographs, text, layouts, and software, are owned by or licensed to NOCT Eyewear and protected by applicable intellectual-property laws. You may use the site only for personal, non-commercial shopping. You may not copy, reproduce, distribute, modify, scrape, sell, or exploit site content without written permission.

Acceptable use

You may not use the services for unlawful, fraudulent, abusive, or harmful activity; interfere with security or operation; introduce malicious code; impersonate another person; collect information about others without authorization; attempt unauthorized access; or violate the rights of NOCT, Shopify, or any third party.

Third-party services and links

Some features rely on Shopify and other third-party services. We do not control third-party sites or services and are not responsible for their independent terms, content, availability, or privacy practices. Review their terms before using them.

Feedback and submissions

If you voluntarily submit feedback or ideas, you grant us a non-exclusive, worldwide, royalty-free right to use them to operate and improve our business, without an obligation to compensate you. Do not submit material that infringes another person's rights or contains unlawful or harmful content.

Errors and service changes

We may correct errors, update information, suspend features, or modify the services at any time. We do not guarantee that the site will always be uninterrupted, secure, or error-free.

Disclaimers

To the maximum extent permitted by law, the site and services are provided on an “as available” basis. We disclaim warranties that can legally be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

Limitation of liability

To the maximum extent permitted by law, NOCT Eyewear and its service providers will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the services. Where liability cannot be excluded, it is limited to the amount you paid for the product or service giving rise to the claim, unless applicable law requires otherwise.

Indemnification

To the extent permitted by law, you agree to indemnify NOCT Eyewear for third-party claims arising from your unlawful use of the services or material breach of these Terms. This does not apply to claims caused by our own unlawful conduct.

Termination

We may suspend or terminate access when reasonably necessary to protect the store, customers, or third parties, or when these Terms are materially violated. Provisions that by their nature should survive termination will continue to apply.

Severability and waiver

If part of these Terms is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. These Terms are subject to applicable law and mandatory consumer protections.

Changes

We may update these Terms by posting a revised version with a new effective date. Continued use after an update means you accept the revised Terms to the extent permitted by law.
